Welcome to Moolah.so (“we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your use of our website, app, and associated services (collectively, the “Services”). By using Moolah.so, you agree to these Terms. If you do not agree, please do not use our Services.


1. Eligibility


To use Moolah.so, you must:


  • Be at least 18 years old.

  • Reside in Australia.

  • Have the legal capacity to enter into a binding agreement.


2. Our Services


Moolah.so offers digital tools to help you manage your personal finances. Our services include:


  • Budgeting, forecasting, and goal tracking tools.

  • Open Banking integrations to access your banking data.

  • Visualisation of your financial position based on the data you choose to share.


We do not provide financial advice. The information provided is general in nature and for informational purposes only.


3. Banking Data Access and CDR Consent


Moolah.so operates under the Consumer Data Right (CDR) framework using Open Banking data access.


  • We access your banking data as a CDR Representative of Basiq Pty Ltd (ABN 76 601 742 181), an Accredited Data Recipient under Australian law.

  • By connecting your bank accounts, you provide explicit consent for us (via Basiq) to access and process your financial data.

  • You can manage or revoke your consent at any time through your Moolah.so account settings.

  • Your credentials are never stored by Moolah.so; they are handled securely by Basiq.

4. Third-Party Services and Hosting


We rely on several trusted third-party services to deliver our platform:


  • Basiq: For Open Banking integrations and data consent management.

  • Xano: Our backend infrastructure is powered by Xano and hosted on Google Cloud, with all data stored in Australia to ensure compliance with local data laws.


We are not responsible for the content, security, or privacy policies of third-party services outside our control.


5. Privacy and Data Handling


Your privacy is important to us. Please refer to our Privacy Policy for detailed information on:


  • What data we collect and why.

  • How we store and use your information.

  • How you can access, correct, or delete your personal data.


We store all data on Australian servers and implement industry-standard encryption and access control practices.


6. Security


We use reasonable security measures to protect your information, including:


  • Encryption in transit and at rest.

  • Secure API connections between services.

  • Hosting on compliant, secure Australian cloud infrastructure.


However, no system is completely secure. You use Moolah.so at your own risk.


7. User Responsibilities


You agree to:


  • Keep your login details secure and confidential.

  • Provide accurate and current information.

  • Use our services for lawful, personal purposes only.


You must not:


  • Use the Services for fraudulent or unlawful activities.

  • Disrupt or interfere with the operation of the platform.

  • Reverse engineer or scrape any part of the Services.


8. Third-Party Content and Features


Where we provide access to third-party services or content (e.g. credit score tools, linked institutions), you:


  • Acknowledge that those services may have their own terms and privacy practices.

  • Agree to review and comply with those terms where applicable.


9. No Financial Advice Disclaimer


We do not hold an Australian Financial Services Licence (AFSL) and do not offer financial product advice.


All financial projections and insights are general in nature and may not reflect your personal situation. You should consider seeking advice from a licensed professional.


10. Service Availability


We aim to provide uninterrupted access to our Services, but:


  • We do not guarantee availability, reliability, or error-free operation.

  • We may suspend or terminate Services for maintenance, upgrades, legal compliance, or misuse.


11. Limitation of Liability


To the fullest extent permitted by law:


  • We exclude all warranties not expressly stated in these Terms.

  • We are not liable for indirect, incidental, or consequential losses.

  • Our total liability is limited to the greater of AUD $100 or the amount you paid us (if any) in the 12 months before a claim arises.


12. Indemnity


You agree to indemnify Moolah.so, its staff, and contractors from any loss, liability, or claim arising from:


  • Your use or misuse of the Services.

  • Your breach of these Terms or any applicable law.


13. Modifications to Terms


We may update these Terms from time to time. When we do:


  • We will update the “Last updated” date.

  • We may notify you of material changes via email or in-app alerts.

  • Continued use of the Services after changes are published constitutes your acceptance of the updated Terms.


14. Termination


We may suspend or terminate your access if:


  • You breach these Terms.

  • You revoke consent for essential data access.

  • We discontinue the Services.


You may close your account at any time.


15. Governing Law


These Terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of that jurisdiction.
